What Is Probate?
Probate is the official submission and approval by a Surrogate’s Court in the county in which the individual is located of the Last Will and Testament of the decedent. In the probate process, the Will is reviewed by the Court and, if it follows all formalities, will be accepted by the Court as the official Will (“probated”) of the decedent. The Executor designated in the Will will then be officially appointed by the Court to act as official representative of the Estate. (An Administrator is generally named by a Court in the event that there is no Will.)
